Terms of Service

These terms govern your use of the pollmill.com online survey platform, operated from Lithuania. By creating an account, creating a survey, or answering one, you agree to these terms and to our privacy policy. If you do not agree, do not use the service.

Accounts

To create surveys you need an account with a valid, confirmed email address. You must be legally able to enter into a contract or have the consent of a parent or guardian. You are responsible for keeping your password secret and for everything done through your account. Notify us immediately if you suspect unauthorized access.

We may suspend or delete accounts that breach these terms, remain unconfirmed, or show no activity for a prolonged period.

Acceptable Use

You must not use the service to publish or collect anything unlawful, deceptive, defamatory, hateful, harassing, sexually explicit, or infringing on anyone's rights. You must not run phishing surveys, impersonate others, or collect passwords, payment card numbers, or similar credentials. You must not collect special categories of personal data (such as health, religion, or political opinions) unless you have a lawful basis to do so.

You must not manipulate results, submit automated or bulk responses, scrape the service, probe its security, or interfere with its operation. Surveys shown in our public survey lists, including their questions and answers, must not be used for advertising, link building, keyword placement, or other search engine optimization purposes. We may use automated filters and may remove any survey, response, or file that we consider to violate these terms, and may delete the account behind it, without warning and at our sole discretion.

Surveys and Responses

You keep ownership of the surveys, questions, images, and other content you create. You grant pollmill.com a worldwide, non-exclusive, royalty-free license to host, store, copy, display, translate, analyze, and otherwise process that content to the extent needed to operate, secure, and improve the service.

You are the data controller of the responses you collect and we process them on your behalf. You are solely responsible for having a lawful basis to collect them, for informing respondents about how you use their data, and for honoring their rights.

Surveys set to public or advertised are visible to anyone, including search engines, and may be listed in our public survey directory. Responses are shown to the survey owner and, where the owner enables it, to other respondents. Review your survey settings before sharing a link.

Respondents

When you answer a survey your response goes to the person or organization who created it, not to us. We do not control, review, or guarantee how survey owners use the responses they collect. Anything you upload, including files and images, must be yours to share and lawful.

Invitations

When sending survey invitations by email you may only use addresses of people who have agreed to receive messages from you. You must not import purchased, harvested, or otherwise unsolicited address lists. We may limit invitation volume, honor unsubscribe requests on your behalf, and suspend accounts that generate complaints or bounces.

Credits and Payments

Paid features, such as invitations, AI assistance, certificates, survey promotion, and file storage, are paid with prepaid credits. Current prices and credit packages are shown in the service and may change at any time; changes do not affect credits already purchased. Some features deduct credits daily for as long as they remain enabled.

Payments are handled by third-party payment providers, and you agree to their terms. By purchasing credits you request immediate delivery and acknowledge that you lose the right of withdrawal once the credits are added to your account. Credits have no cash value, cannot be transferred or exchanged for money, and are not refunded, including credits received free of charge or on account deletion.

If your balance reaches zero, features that require credits stop, promoted surveys are unlisted, and stored files may be removed. We may reverse credits obtained through fraud, chargebacks, or abuse, and may recover any resulting costs from you.

AI Features

Question suggestions and translations are generated automatically by third-party AI models and may be inaccurate, incomplete, or inappropriate. Content you submit to these features is sent to the AI provider for processing. You are responsible for reviewing AI output before using it.

Third-Party Services

The service integrates sign-in, payment, media embedding, and other third-party services, and surveys may link or redirect to external websites. We are not responsible for the content, availability, or practices of those third parties.

Our Intellectual Property

The platform, its software, design, logos, and text belong to pollmill.com and its licensors. You may not copy, modify, scrape, resell, or create derivative works from any part of the service except as these terms allow. You may link to pollmill.com as long as the link is not misleading and does not imply endorsement; our logo may not be used without written permission.

Availability and Changes

We may change, suspend, or discontinue any part of the service at any time. We may change these terms by publishing a new version on this page; continued use after publication means you accept the changes. Where feasible we will notify account holders of material changes by email.

You may stop using the service at any time and may export your survey results before doing so. After an account is deleted its surveys, responses, and files may be permanently removed and cannot be recovered.

Disclaimer and Liability

The service is provided "as is" and "as available" without any warranty of accuracy, availability, data preservation, or fitness for a particular purpose. You are responsible for keeping your own copies of important data.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential loss, lost profits, lost data, or any damage arising from survey content, responses, AI output, third-party services, or unauthorized use of your account. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

You agree to indemnify and defend pollmill.com against any claim, loss, or cost arising from your content, your surveys, your processing of respondent data, or your breach of these terms.

Nothing in these terms limits liability that cannot be excluded under applicable law, including for death or personal injury caused by negligence, for fraud, or mandatory consumer rights.

Governing Law

These terms are governed by the laws of the Republic of Lithuania, and disputes are subject to the courts of Lithuania. If you are a consumer in the European Union you also keep the protection of the mandatory rules of your country of residence.
